Introduction

By participating in dog training activities with Black Dog Training, LLC, you agree to the following Terms and Conditions:

Waiver and Release

Participant, or Participant’s parents or legal guardian in the case of minor Participant, voluntarily releases, discharges, waives, relinquishes and covenants not to sue with respect to any and all actions or causes of action for bodily injury to Participant, and to Participant’s dog, arising either directly or indirectly out of the participation of Participant in Black Dog Training activities (“Dog Training Activities”), wherever or however the same may occur and for whatever time period related to such Dog Training Activities and whether the same shall arise in whole or in part from the negligence of Black Dog Training or its employees, or the negligence of any other person or any third party and whether such negligence is the sole and concurring cause of the bodily injury to Participant or Participant’s dog.

Indemnity – Third Party Claims

If a Participant’s dog injures another Participant or Participant’s dog, Participant, or Participant’s parents or legal guardian in the case of a minor Participant, indemnifies and holds harmless Black Dog Training and its employees from any and all claims, actions, demands, costs, liabilities, expense or judgments whatsoever, including attorney’s fees and costs related to such injury.

Responsibilities of Participant

Participant, as a condition of participation in the Dog Training Activities, shall do all of the following:

• Maintain control of his or her dog (or dogs) while involved in such Dog Training Activities;

• Heed all warnings regarding participation in the Dog Training Activities;

• Act within the limits of his or her dog’s activities and past training; and,

• Refrain from acting in any manner that may cause or contribute to the injury to himself (or herself), any other Participant’s dog, or to other persons and/or Participants.

Refund Policy

All fees are non-refundable. Consideration, however, may be given to applying the fees to another Black Dog Training Class, upon rescheduling, but such application of the fees is at the sole discretion of Black Dog Training.

Photographic Consent and Release

Participant, or Participant’s parents or legal guardian in the case of a minor Participant consents to be photographed and/or videotaped while participating Dog Training Activities and allows Black Dog Training to utilize such photographs or videos in the furtherance of Black Dog Training’s operation or advertising, as long as such use is legal under Wisconsin law.
